Surface Pro 2 Windows 10 Issues

After upgrading to Windows 10 my Surface Pro 2 brightness level is permanently on the highest setting with no ability to reduce it. I, therefore, have limited use when on battery power. I additionally cannot go into to sleep mode and there are also no screen resolution options available.

The Intel Graphics Family Driver version is: 10.18.15.4256. Intel's Downloader is recommending against upgrading because "a customized computer manufacturer driver is installed" even though it appears that more recent updates are available.

Although it otherwise appears to functioning normally the "Device Status" reports: Windows has stopped this device because it has reported problems. (Code 43).

I've been to the Microsoft Store 3 times and the (Level 1) techs tell me that they cannot do anything for me; they do not repair Surface Pro 2's; and offered me a ridiculously low exchange credit against a newer model.
